Terms of Service — Our Fam!

Welcome to Our Fam! ("the app," "we," "us"). These Terms of Service ("Terms") govern your use of the app. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Eligibility

You must be at least 13 years old to create an account on your own. Accounts for children under 13 may be created and managed only by a parent or legal guardian, who accepts these Terms on the child's behalf and is responsible for the child's use of the app. By creating an account, you confirm that you meet these requirements.

2. Your Account

You are responsible for keeping your login credentials secure.
You are responsible for the activity that occurs under your account.
Provide accurate information when creating your account.

3. Acceptable Use

The app is intended for private use among members of a family or trusted group. You agree not to:

Use the app for any unlawful purpose or in violation of these Terms.
Harass, abuse, threaten, or harm another person.
Attempt to access accounts, families, or data that are not yours.
Interfere with, disrupt, or attempt to compromise the security of the app.
Upload content you do not have the right to share.

4. Your Content

You retain ownership of the messages, lists, photos, and other content you create in the app ("Your Content"). Because your private content is end-to-end encrypted, we cannot read it. You grant us only the limited technical permission needed to store and transmit Your Content so that your family members can receive it. You are responsible for Your Content and for ensuring you have the right to share it.

5. Privacy

Your use of the app is also governed by our Privacy Policy, which explains how information is handled.

6. Service Availability

We work to keep the app available and reliable, but we provide it on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time. The app relies on third-party services (such as cloud hosting and messaging) whose availability we do not control.

7. Disclaimer of Warranties

To the fullest extent permitted by law, the app is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that location features will be accurate or timely.

      ⚠️ Safety notice: Location information may be delayed, inaccurate,
      or unavailable, and can be affected by your device, network, and settings. Do
      not rely on Our Fam! as your sole means of locating a person, and
      never rely on it in an emergency. In an emergency, contact your local emergency
      services immediately.
    

8. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the app.

9. Termination

You may stop using the app and delete your account at any time from Profile → Manage My Data; see how to delete your account for the full steps and what is removed. We may suspend or terminate access if you violate these Terms.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
